RFE and NOID deadlines on a VAWA case: 12 weeks, 30 days, no extensions

If USCIS needs more on your VAWA self-petition, it sends a Request for Evidence or a Notice of Intent to Deny. An RFE response period cannot exceed 12 weeks and a NOID response period cannot exceed 30 days, and there are no extensions under 8 C.F.R. 103.2(b)(8)(iv). The date on the notice is the date that counts.

Current as of October 2026. We re-check this page every quarter and after any change in the law.

This post is dated October 26, 2026. It is for anyone who filed a VAWA I-360 and has received, or is afraid of receiving, a letter from USCIS asking for more. The short answer: the letter is not a denial, but its deadline is real and cannot be moved.

Two kinds of letter

If the initial evidence is missing or does not establish eligibility, USCIS has three choices: deny outright, send a Request for Evidence (RFE), or send a Notice of Intent to Deny (NOID) (8 C.F.R. 103.2(b)(8)(ii)-(iii); 3 USCIS-PM D.4(B)). An RFE asks for something more. A NOID says USCIS plans to deny and must state the bases for the proposed denial (8 C.F.R. 103.2(b)(8)(iv)). Either one may come by regular or electronic mail (8 C.F.R. 103.2(b)(8)(iv)).

The deadlines

NoticeLongest response periodExtensionsAuthority
Request for Evidence12 weeksNone8 C.F.R. 103.2(b)(8)(iv)
Notice of Intent to Deny30 daysNone8 C.F.R. 103.2(b)(8)(iv)

Those are ceilings. The notice itself sets the due date, and it can be shorter. Read the date on the notice first, then count backward to plan when the packet has to be in the mail.

No extensions

USCIS may not grant additional time to respond to an RFE or a NOID (8 C.F.R. 103.2(b)(8)(iv)). Do not plan around a request for more time.

What to send

Within the period, you have three options under 8 C.F.R. 103.2(b)(11): submit a complete response, submit a partial response and ask for a decision on the record, or withdraw the petition. The rule has two traps:

  • Send everything together. All requested materials go in at once, with the original notice on top (8 C.F.R. 103.2(b)(11)).
  • A partial response ends the conversation. Sending only some of what was asked counts as a request for a decision on the record (8 C.F.R. 103.2(b)(11)). You do not get to send the rest later.

If a document truly cannot be had, say so in the response, explain why, and send what shows the same fact. USCIS must consider any credible evidence (INA 204(a)(1)(J)), and a self-petition may not be denied for failure to submit a particular piece of evidence (3 USCIS-PM D.5(B)(1)-(2)). Every foreign-language document needs a full certified English translation (8 C.F.R. 103.2(b)(3)). See any credible evidence.

A NOID is the last chance on the record

A NOID lists the reasons USCIS plans to deny (8 C.F.R. 103.2(b)(8)(iv)). Answer each one, in order, with evidence and a short cover explanation. Since PA-2025-33, the Policy Manual asks for primary evidence of the marital relationship for good-faith marriage, and says hurtful conduct alone is not enough for extreme cruelty (3 USCIS-PM D.2(C), D.2(E)(1)). Those are common themes to check against the notice. A supplemental declaration that answers the officer's specific concern can do more than a stack of new paper. See how to prepare a VAWA declaration.

If the date passes

If no response arrives by the due date, the petition may be denied as abandoned, on the record, or both (8 C.F.R. 103.2(b)(13)(i)). Missing a required interview or biometrics appointment is treated as abandonment unless a change of address or rescheduling request arrived first (8 C.F.R. 103.2(b)(13)(ii)). An abandonment denial cannot be appealed, but you may file a motion to reopen under 8 C.F.R. 103.5 (8 C.F.R. 103.2(b)(15)).

A motion to reopen or reconsider is due within 30 days of the decision, plus 3 days if it was mailed (8 C.F.R. 103.5(a)(1)(i); 8 C.F.R. 103.8(b)). A denial also does not stop a new self-petition (3 USCIS-PM D.6(B)). See I-360 denied.

Make sure the mail reaches you

An RFE you never see still has a deadline. If you moved, or the abuser can reach your mail, update your safe mailing address with USCIS and tell your lawyer. Our safe filing checklist covers this. If you are in danger now, call 911.

We do not publish how long USCIS takes to issue or decide after an RFE; see uscis.gov/processing-times. For a private consultation on a notice you received, call (718) 484-7510.

Common questions

Can I ask USCIS for more time to answer an RFE?

No. An RFE response period may not exceed 12 weeks, a NOID response period may not exceed 30 days, and additional time to respond may not be granted (8 C.F.R. 103.2(b)(8)(iv)). Work from the due date printed on the notice.

What if I cannot get every document USCIS asked for?

You may send a complete response, send a partial response and ask for a decision on the record, or withdraw (8 C.F.R. 103.2(b)(11)). Sending only part of what was asked counts as a request for a decision on the record, so explain in the response why something is missing and what you are sending in its place.

What happens if I miss the deadline?

The petition may be denied as abandoned, on the record, or both (8 C.F.R. 103.2(b)(13)(i)). An abandonment denial cannot be appealed, but a motion to reopen under 8 C.F.R. 103.5 is available (8 C.F.R. 103.2(b)(15)). Motions have their own 30-day deadline (8 C.F.R. 103.5(a)(1)(i)).
